“ARE YOU REGISTERED WITH THE STATE OF OREGON AND THE UNIVERSITY OF OREGON?”
DEFINITION OF A SPORTS AGENT (LEGALLY KNOWN AS THE ATHLETE-AGENT)
• In the eyes of the law in the State of Oregon (Uniform Athlete Agent Act enacted in 2000) an agent may include, but is not limited to, a certified contract advisor (typically referred to as the sports agent), financial advisor, marketing representative, brand manager or anyone who is employed or associated with such persons.
• The NCAA defines an agent as any individual who, directly or indirectly, represents or attempts to represent an individual for the purpose of marketing his or her athletics ability or reputation for financial gain, or seeks to obtain any type of financial gain or benefit from securing a prospective student-athlete's enrollment at an educational institution or from a student-athlete's potential earnings as a professional athlete.
• Every agent … regardless of what state they are located in … must be registered in the State of Oregon if contacting a student-athlete in any institution within the State of Oregon.
ESSENTIALLY AN AGENT IS ANYONE WHO SEEKS TO REPRESENT OR TO GAIN PROFIT ON A STUDENT-ATHLETE’S ATHLETIC ABILITY
Revisions to the original act with HB 3296 (2012) and SB 5 (2017) criminalizes sports agents who break the law with substantial criminal penalties including significant fines. We have been assured by our Attorney General that our State government will pursue and prosecute those people who violate the State laws.
5 BASIC RULES
The 5 basic rules when communicating with a sports agent:
1. In football, a student-athlete must be three (3) years removed from high school and be eligible for the upcoming professional draft (NFL rule).
2. The agent must be registered with the Oregon Department of Education as a sports agent (Oregon state law). See *link below.
3. The agent must be registered with the institution in Oregon that the student-athlete attends (Oregon state law). See **link below.
4. The student-athlete cannot accept anything of value (i.e., not even a cup of coffee) while they still have eligibility remaining (NCAA rule). We recommend that student-athletes and their families never meet in a restaurant or anyplace where a meal or where refreshments are offered for purchase. Always meet in a business setting. The UO will provide meeting space. This eliminates any complications with the NCAA.
5. The student-athlete cannot agree to representation (either verbally or in writing) in the pursuit of post-collegiate athletic opportunities while they still have eligibility remaining (NCAA rule). Representation regarding NIL opportunities is permitted.

The University of Oregon supports their student-athletes by assisting in the vetting and interview process between sports agents and their student-athletes in order to help them:
• Obtain the best representation possible.
• Follow all state (UAAA), federal laws (SPARTA) and NCAA rules.
